Producer of Brazilian Blowout Settled for $4.5 M Class-action Lawsuit

After hearing a lot of alarming complaints from stylists and people who have used Brazilian Blowout, the makers of this hair styling agent has finally agreed to settle the class-action lawsuit. Included in the agreement is the payment of $35 to every person who received the treatment and had complained. Each can be compensated up to three times of treatment. This also affects salon stylists which will receive $75 compensation for every bottle of Brazilian Blowout that they bought.

Earlier this year GIB the same company who markets Brazilian Blowout also agreed to pay $600,000 fines to California attorney general. The fine was imposed on mislabeling two of their products to be formaldehyde free. The substance has been labeled by federal government to be carcinogenic. Chief executive of Brazilian Blowout welcomed the settlement as an acquittal; it means that they can sell their products without reformulating it. Overall the said settlement will sum up to $4.5 million which will be covered by the company’s insurance. This amount is desirable compared to re-branding and reformulating it.

It would have been bad for the company if they have contested the class-action lawsuit. It could end up very bad, but it’s a good thing for them to okay with such an agreement. They just need to admit that they are wrong and needed pay some sort of fines.  From now on they will be able to sell their products without restriction. But including in the agreement is that they will provide ads which will warn users regarding the formaldehyde contents of the products and the health risks when exposed to it. They will also provide extensive instruction on how to safely use the product. So long as it’s used on a well ventilated area, it should not harm anyone exposed to it.

Still there are groups who are not happy with the settlement. They believe that this is a slap on the people’s faces. Each treatment of Brazilian Blowout will regularly cost $300 and it promises a smooth and shinny hair after treating frizzy hairs.  But is the $35 compensation really justifiable? Has the government gone soft on regulations on cosmetic products? These are the questions that activists and lobbyists like Campaign for Safe Cosmetics have in mind that searches for an answer. So long as these people does not give up the controversy will be present.

California Court to Hear a Ban on Brazilian Blowout

The original date of hearing was set for November 17, 2011 until it was delayed and set to be on December 16, 2011 by Superior Court of the State of California, County of Los Angeles. The hearing is set to determine the points and arguments between the people of state of California and GIB maker of Brazilian Blowout in regards of alleged health hazards that the said products would bring to its consumers. The argument concluded that the covering issue is not a simple technicality of the law. It argues that while Brazilian Blowout products by GIB’s are still on the market and still being used by salon stylist, health damage is eminent. Unless otherwise the manufacturer will comply with regulations set by California court of laws in relation to cosmetic care products.

It would seem that the lurking health issues that Brazilain Blowout has been tainted with political intentions. Parties are now taking side but carefully testing the waters, just what politicians would do. The issue has been there for months and claims have been presented. FDA and other state agencies that monitor the contents of cosmetics products have heard the same thing. But it all comes to nothing as many stylists would still offer the products to willing customers. Either Brazilian Blowout hair smoothening product contains harmful contents or carcinogenic elements or not, the truth is the product is still on the market, people are enjoying the benefits it offers, businesses are making money, politicians are gaining popularity. The government on the other hand is spending taxpayers’ money to hear and investigate the staged drama.

Despite Recent Events, Salons Still Offering Brazilian Blowout!

Well, we asked – and you responded!  We received numerous emails and contacts through this website since our last post asking if salons are still performing the Brazilian Blowout and if customers are still asking for it and the consensus is that most of you still LOVE the product!  Most salon owners responded that they are still offering the Brazilian Blowout.  Some salons reported that some of their stylists have chosen not to perform the BB due to health reasons, but the ones that are certified still mostly have at least 1 stylist who can perform the treatment for customers who want it.  From the client’s point of view, despite all of the negativity you may see on the Internet, a lot of you still love the product and are still planning on getting it done.  The media tends to always “blow” things way out of proportion, and this instance was no different.  Despite the fact that BB is now apparently not arguing with the fact that the product has some formaldehyde in it, people don’t seem to mind.  Personally, I can’t say I agree with the fact that they denied it for so long and wish they had just been more forthcoming with their ingredients but I’ll give them the benefit of the doubt and let it slide.  The product really is great, and unless you have some sort of allergy to it I can’t see it being too harmful.  At least, no more harmful than other comparable things we are exposed to on a daily basis.  I’m no doctor or scientist so obviously don’t assume I’m correct here, but that’s just my opinion. :)   Now, let’s all try to put this mess behind us and focus on the product as it stands today and not dwell on the past!
